UK REACH registration
Following the UK’s withdrawal from the EU, the EU REACH Regulation was brought into UK law on 1 January 2021, known as “UK REACH” and covering access to Great Britain’s (England, Scotland, Wales) jurisdiction market. The key principles, objectives and provisions of the EU REACH Regulation have been retained – for example, GB-based manufacturers and importers of substances in quantities of 1 tonne or more per year must submit registration dossiers to the UK Health and Safety Executive (HSE).
The REACH Copper Consortium has agreed that the European Copper Institute, as Consortium Secretariat, will additionally oversee the UK REACH registration process for the Consortium’s substances, providing support to its members and data access for non-members via License to Use (LtU) agreements.
The ECI Secretariat provides guidance to ensure that the relevant duties are met under UK REACH, and supports companies’ preparation for registration of copper substances. ECI is carrying out the required administrative, secretarial and/or technical tasks. This includes, for instance, to:
- Plan activities until the relevant registrations
- Provide guidance, respond to inquiries and coordinate the preparation of the registration process and dossier data set, define strategy for registration and identify lead registrants
- Participate in a Cross-Metal UK REACH Forum
- Handle data access inquiries and set up the data access agreements
- Monitor GB REACH registration requirements
Data access
The following rules shall apply to the access to the data set for UK REACH registration purposes, in the scope of the Consortium work, for the purposes of registration under GB REACH:
- Consortium Members, their affiliates and current holders of LoA agreements for Consortium substances shall continue their data rights, subject to the set-up of relevant agreements. An administrative fee will cover the administrative costs under GB REACH, but no data access fee is charged.
- New registrants under GB REACH, that did not previously hold access rights under the EU REACH Regulation, require the set-up of a new data access agreement and shall pay an administrative fee to cover the administrative costs under GB REACH and data access fee.
